The Tylenol autism lawsuit is attracting attention at the national level and as a result of it, Johnson & Johnson, along with several major retailers across the United States, including Walmart, Walgreens among others are facing more than 100 lawsuits from the families of children with autism or ADHD caused from the use of Tylenol during pregnancy.

The litigation came up after many studies were published highlighting the link between autism and Tylenol & ADAD which were caused by exposure to the active ingredient acetaminophen before birth.

The complainants have raised similar allegations that say that the makers of the brand Tylenol and generic acetaminophen products have failed to warn women about the risks associated with the medications that may emerge if taken during pregnancy. Earlier, the drug was promoted as a safe and effective pain medication option.

Many American and European scientists in 2021 rose alarm on the data showing a consistent association between Tylenol or acetaminophen used by pregnant women and autism or attention-deficit/hyperactivity disorder (ADHD) diagnosed in their children. This group of scientists also signed a consensus statement and urged pregnant women to minimize their use of Tylenol or acetaminophen during pregnancy.

The Lawsuit Is Still In The Early Phase

The multidistrict lawsuit against Tylenol/acetaminophen is still underway as the litigations are common in nature with common questions. Technically, it can be said that the case is not on trial yet. The US Judicial Panel on Multidistrict Litigation (JPML) has ordered to centralize and consolidate all the lawsuits against Tylenol manufacturers and acetaminophen retailers before the US District Judge Denise Cotes in the Southern District of New York in October 2022.

In January 2023, it was reported that the judge presiding over the case ordered a discovery plan that allows the parties to focus on compiling studies and evidence that link ADHD or autism to Tylenol exposure during pregnancy.

Judicial Panel on Multidistrict Litigation in its MDL docket report report published on February 16, 2023, said that the number of litigations has already doubled to 107 Tylenol autism and ADHD and it expects the litigations to increase further in the coming days.

What is Tylenol?

Tylenol is a commonly recommended drug – as an alternative to non-steroidal anti-inflammatory drugs (NSAIDs) for pregnant women seeking pain relief and reduction in fever. It is a brand name for acetaminophen, a.k.a. paracetamol across the world. Acetaminophen is generally prescribed as an analgesic (pain reliever) and antipyretic (fever-reducing agent).

Research has found that the use of Tylenol or Acetaminophen can negatively affect a child if the mother uses it during pregnancy. New research is showing a link between the use of these drugs during pregnancy and the development of autism spectrum disorder (ASD) and attention-deficit/hyperactivity disorder (ADHD) among children.

In May 2021, the European Journal of Epidemiology published a study saying children exposed to acetaminophen before birth were 19% more likely to develop autism and 21% more likely to show signs of attention-deficit hyperactivity disorder (ADHD).
