Paragard IUD Lawsuits

Paragard IUD Lawsuits: Understanding Your Rights and Potential Compensation

What Is Paragard?

Paragard is a popular non-hormonal intrauterine device (IUD) used by millions of women as a long-term birth control option. While many have found Paragard to be an effective contraceptive, there have been growing concerns and reports of serious complications associated with its use. These complications have led to numerous lawsuits against the manufacturers, seeking justice and compensation for those affected.

Why Are Paragard Lawsuits Being Filed?

Lawsuits are being filed against the makers of Paragard due to severe side effects and complications reported by users. These include:

  • Device Breakage: One of the most significant issues is the risk of the Paragard IUD breaking upon removal, which can cause serious injuries and require surgical intervention.
  • Perforation: The device has been reported to perforate the uterine wall, leading to internal injuries and complications.
  • Migration: There have been instances where Paragard has migrated from its original position, causing pain and further complications.
  • Inadequate Warnings: Plaintiffs claim that the manufacturers did not adequately inform users or healthcare providers about these risks.

These issues have led to physical and emotional distress, as well as financial burdens due to medical treatments and lost wages. The lawsuits aim to hold the manufacturers accountable and secure compensation for those who have suffered.

Who Is Eligible to File a Paragard Lawsuit?

If you or a loved one has experienced any of the following after using a Paragard IUD, you may be eligible to file a lawsuit:

  • The device broke during removal
  • Required surgery to remove broken fragments
  • Experienced perforation of the uterus or other internal organs
  • Suffered from severe pain or complications due to device migration

It’s essential to consult with a legal expert who specializes in Paragard cases to determine your eligibility and the potential value of your claim.

What Compensation Can You Expect?

Victims of Paragard-related injuries may be entitled to various forms of compensation, including:

  • Medical Expenses: Coverage for past and future medical bills related to the injury.
  • Lost Wages: Compensation for time missed from work due to injury or recovery.
  • Pain and Suffering: Financial compensation for the physical pain and emotional distress caused by the injury.
  • Punitive Damages: In some cases, courts may award punitive damages to penalize the manufacturer for negligence.

The payout value of Paragard lawsuits varies depending on the severity of the injuries and the specifics of each case. Consulting with a legal professional will help you understand the potential compensation you might receive.

Ongoing Litigation and Current Case Statistics

As of August 2024, the litigation involving the Paragard intrauterine device is active and significant. There are 2,774 pending lawsuits and a total of 2,860 cases filed against CooperSurgical and Teva Pharmaceuticals in federal court in Georgia, consolidated under Multidistrict Litigation (MDL) number 2974.

The first of the bellwether trials, which are intended to set the stage for further proceedings, was initially set to begin in October 2024. However, due to ongoing discovery and procedural developments, it now appears likely that these trials will not commence until 2025.

Recent Developments in Paragard Litigation

July 2024:

A status conference was planned for the end of the month, which could provide more information on the progress of the litigation.

December 2023:

Several new cases were added to the MDL, and conditional transfer orders were issued. Lawyers are still accepting new cases from women who have experienced issues with their Paragard IUD.

September 2023:

Judge May outlined the protocols for depositions for bellwether trial plaintiffs. The first trial is anticipated to occur on or before October 28, 2024.

February 2023:

The judge established a process for selecting 10 cases to serve as the initial bellwether test trials set to take place in 2024.

January 2023:

Judge M. Gino Brogdon Sr. (retired) was appointed as a settlement mediator, indicating ongoing negotiations for a potential global settlement.

September 2022:

Discovery for selected Paragard lawsuit bellwether cases was scheduled to continue until at least fall 2023.

Why Act Now?

Statutes of limitations apply to product liability cases like those involving Paragard, meaning there is a limited time to file a lawsuit. Delaying action could result in losing your right to seek compensation.
